Charlie Sheen has been released from jail after posting an $8,500 bail bond.

The 44-year-old actor spent around 10 hours in custody on Christmas Day, after being arrested on suspicion of assaulting his wife.

He is due to appear in court on February 8 next year.

Cops arrested Sheen at a house in Aspen, Colorado, – which his wife Brooke Mueller has reportedly been renting – after receiving a 911 call at 8.34am on Christmas morning.

A source close to Mueller, a real estate investor, told celebrity news website Radar Online that Sheen pushed Mueller after they began rowing.

The same source claimed the couple, who wed in 2008 and have nine-month-old twin sons, have been having ‘significant marital problems’ but Sheen had reportedly flown to Aspen to spend Christmas with his wife.

Cops responded to the ‘domestic violence situation’, arrested Sheen and took him to the Pitkin County Jail.

A spokeswoman for the Pitkin County Sheriff’s Department confirmed the actor was arrested on suspicion of second degree assault, menacing (knowingly placing someone in fear of imminent serious bodily injury) and criminal mischief (willfully damaging someone else’s property).

“All charges are coupled with a domestic violence component,” the spokeswoman said.

A US celebrity news website claimed Mueller was legally drunk when she made the emergency call to police.

A source told TMZ she gave a breathalyzer reading of .13, while her husband registered .04. The legal driving limit is .08.

Sheen, whose real name is Carlos Irwin Estevez, met with 9th Judicial District Court Judge James Boyd in jail and a protection order was issued between him and Mueller.

Under Colorado law, a protection order must be made between domestic violence arrestees and their alleged victims before the arrestee can be released from custody.

Sheen was released from custody at 7pm after posting an $8,500 bond. He is understood to have hired Colorado lawyer Richard Cummins to represent him.

‘Do not be misled by appearance,’ Sheen’s publicist Stan Rosenfield said. ‘Appearance and reality can be as different as night and day.

‘It would benefit everyone not to jump to any conclusion.’
